General Terms and Conditions of Zürich Tourism
I. Scope of General Terms and Conditions
1. Zurich Tourism as Provider / Organizer
These general terms and conditions (hereinafter: ‘T&Cs’) govern the contractual relationship between customers and Zurich Tourism (an association with its seat at Gessnerallee 3, 8001 Zurich, registered in the Commercial Register of the Canton of Zurich under number CHE 105.846.358) for services for which Zurich Tourism itself acts as the provider / organizer (e.g., city tours, the sale of Zurich Tourism merchandising items, consulting services, the Zürich Card). These T&Cs must be accepted by the customer at the time of placing an order. Further details are set out in Section III below.
2. Zurich Tourism as Intermediary for Third-Party Services
In the event that Zurich Tourism arranges third-party services (e.g., hotel bookings, city tours, excursions, event tickets, or services arranged through the Convention Bureau), the contract is concluded directly between the respective third party and the customer. Third parties are listed on the Zurich Tourism website. Zurich Tourism acts as intermediary only, even where the entire order process is handled by Zurich Tourism. In all cases where Zurich Tourism acts as intermediary, the general terms and conditions of the respective third party – who is expressly identified as the contracting party in the relevant offer – shall apply. Zurich Tourism does not mediate disputes between customers and third parties. Further details are set out in Section IV below.
II. Zurich Tourism Website and Apps
1. Zurich Tourism Website and App Content
Zurich Tourism operates the website www.zuerich.com and associated sub-pages (hereinafter: ‘Website’) as well as the Zürich City Guide app (hereinafter: ‘App’). Zurich Tourism’s own services are advertised on this Website and App (see Section III below). In addition, Zurich Tourism offers third parties the opportunity to offer their own services on the Website (see Section IV below).
2. Disclaimer of Warranties and Limitation of Liability for Content
All content on the Zurich Tourism Website and Apps is provided solely for general informational purposes. Zurich Tourism strives to ensure that all content is correct, current, and error-free, but makes no representations or warranties as to its accuracy, completeness, or currency. To the extent permitted by law, Zurich Tourism shall only be liable for damages arising from use of the Website or App where such damages result from willful misconduct or gross negligence. Liability for ordinary negligence is excluded to the extent permitted by law. The foregoing limitations do not apply to liability for damages arising from injury to life, body, or health, or as otherwise required by mandatory statutory provisions.
Zurich Tourism makes no warranty that the Website or App will be available without interruption or free from harmful components. Temporary restrictions or interruptions shall give rise to no claims on the part of users.
3. Operating Hours and Availability
The Website and Apps are generally available Monday through Sunday, 24 hours a day. The Website and Apps are offered free of charge and are provided subject to availability. Zurich Tourism endeavors to make its Website and Apps available to users without interruption. However, their use may be limited or temporarily interrupted due to maintenance work, further development, or other disruptions. Zurich Tourism therefore does not guarantee the uninterrupted availability of its Website and Apps. In the event of any such disruption, users shall have no claim to compensation.
4. Links
Zurich Tourism is neither responsible nor liable for the content or functioning of any third-party websites or apps to which links are provided. Zurich Tourism has no influence over the content of these websites and apps. Users access these websites at their own risk.
5. Open Data
Zurich Tourism offers an Open Data Portal. This provides users with access to publicly available data sets on attractions, excursions, restaurants, and accommodations in Zurich and the surrounding region. Use of the Open Data Portal is subject to the license terms published on the portal. To the extent permitted by law, Zurich Tourism excludes all liability for direct and indirect damages arising from use of the Open Data Portal or the data made available therein. Furthermore, Zurich Tourism makes no warranty as to the currency, accuracy, completeness, or precision of the published data.
III. Zurich Tourism as Organizer / Provider
1. Zurich Tourism as Organizer
When Zurich Tourism itself acts as the organizer of city tours, as the issuer of the Zürich Card, or as the provider of any other offerings, the contract between Zurich Tourism and the customer is concluded as described below.
2. Formation of the Contract with Zurich Tourism
The display of goods and services on the Zurich Tourism Website or App does not constitute a legally binding offer, but rather a non-binding online catalog (invitation to submit an offer). A binding offer is only made when the customer has entered all data required to complete the transaction, confirmed acknowledgment of these T&Cs and any applicable cancellation terms, and clicked the ‘Book now with costs’ button. Until that button is clicked, the customer may add products and services to the shopping cart on a non-binding basis and may amend the entered data at any time. Submission of the order constitutes an offer by the customer to enter into a contract. The customer will then receive confirmation that the order has been received (by telephone, in writing, by email, or by system notification). This confirmation does not constitute acceptance of the offer, but merely documents that the order has been received by Zurich Tourism (acknowledgment of receipt). The contract is formed only when Zurich Tourism accepts the customer’s offer and expressly confirms the order (order confirmation).
Where the customer has submitted only a non-binding request for a quote by telephone, in writing, or by email, Zurich Tourism’s response shall constitute the binding offer to enter into a contract. In such cases, the contract is concluded upon the customer’s express acceptance of the offer.
3. Performance and Cancellation
Zurich Tourism undertakes to perform the contractually agreed services with due care and in accordance with the contract.
If performance of the contract becomes impossible for reasons attributable to Zurich Tourism, or if Zurich Tourism cancels the booking, any payments already made by the customer will be refunded in full. Any outstanding amounts due under the canceled booking shall be waived. If performance of the contract becomes impossible for reasons attributable to neither Zurich Tourism nor the customer (in particular in cases of force majeure), any payments already made will be refunded. Any further claims are excluded. If the customer cancels a booked service, the cancellation terms of Zurich Tourism and/or the relevant service provider (e.g., transportation companies) apply. The applicable cancellation terms will be communicated to the customer during the booking process and form part of the contract.
The Zürich Card may be returned at any SBB ticket counter provided it has not yet been used and the validity period has not yet commenced. A fee may be charged for the refund.
4. Liability of Zurich Tourism
In the cases referred to in this Section where Zurich Tourism acts as the organizer, Zurich Tourism shall be liable for willful misconduct and gross negligence. Liability for ordinary negligence and liability for agents and subcontractors is excluded. Zurich Tourism shall not be liable in any case for the customer’s own fault or for the fault of third parties. Liability for loss of profit or for any further direct or indirect consequential damages is excluded.
For consumers habitually resident in an EU member state, in the cases referred to in this Section where Zurich Tourism acts as organizer, Zurich Tourism shall be liable without limitation for damages caused by Zurich Tourism or its agents and subcontractors through willful misconduct or gross negligence, for personal injury caused by fault, and for liability under applicable mandatory statutory provisions. Where Zurich Tourism is in breach of a material contractual obligation through ordinary negligence, liability shall be limited in amount to the damages typically foreseeable at the time of contract formation. Material contractual obligations are obligations whose performance is essential to the proper execution of the contract and on whose fulfillment the customer may reasonably rely. Zurich Tourism shall not be liable for breach of non-material contractual obligations, nor where the customer’s damages were caused by the customer themselves or by third parties whose fault Zurich Tourism is not required to bear under applicable statutory provisions.
The customer is solely responsible for the safekeeping of valuables at events organized by Zurich Tourism.
5. Participation Terms for Events
Participants are required to follow the instructions of the tour leaders, guides, or other persons engaged by Zurich Tourism. In cases of serious non-compliance with instructions or disruption of the event, participants may be excluded from the event. In such cases, no refund will be issued.
If the customer arrives late or fails to appear for the scheduled event, no refund or substitute service will be provided.
Zurich Tourism reserves the right to cancel events if a minimum number of participants is not reached or for operational reasons. In such cases, any payments already made will be refunded in full.
For outdoor events, participants are responsible for providing their own appropriate clothing and personal equipment (e.g., rain protection, sturdy footwear).
6. Force Majeure
If an event or service cannot be carried out due to force majeure (e.g., natural disasters, pandemics, strikes, government action, or other circumstances beyond the control of Zurich Tourism), Zurich Tourism is entitled to cancel the event or withdraw from the contract. In such cases, the amount paid will be refunded. Any further claims, in particular claims for damages, are excluded.
IV. Arrangement of Third-Party Services
1. Third Parties as Organizers and Contracting Partners of the Customer
Where Zurich Tourism arranges third-party services (e.g., hotel reservations, etc.) by publishing third-party offers on its own website or arranging them through the Convention Bureau, the contract for the substantive performance of those services is concluded directly between the customer and the respective third-party organizer. Zurich Tourism does not become a party to that contract. The general terms and conditions of the respective third-party provider shall apply to the arranged services. These T&Cs apply additionally with respect to the use of the Zurich Tourism Website or Apps and the ordering process. In the event of any conflict between these T&Cs and the general terms and conditions of the third-party provider, the provisions of the third-party provider shall take precedence with respect to the arranged service.
2. Formation of Contract with Third Parties

Where the customer has submitted only a non-binding request for a quote by telephone, in writing, or by email, the response received shall constitute the binding offer to enter into a contract with the third party. In such cases, the contract with the third party is concluded upon the customer’s express acceptance of the offer.
3. Performance and Cancellation
Responsibility for performance of the contract lies exclusively with the third party as the customer’s contracting partner. The general terms and conditions of the third party shall govern. Zurich Tourism makes no warranty whatsoever as to the proper performance of the contract by the third party. Any complaints must be directed exclusively and promptly to the relevant third-party provider.
To the extent they exist, the cancellation terms of the third party, as accepted by the customer at the time of inquiry or order, shall govern.
4. Disclaimer of Liability
Zurich Tourism shall not be liable for any damages incurred by the customer in connection with third-party services. Any claims for damages must be directed to the relevant third party. The applicable provisions of the third party’s general terms and conditions shall apply in this regard, among others.
V. Payment Terms and Prices
Unless otherwise agreed by the parties in writing in an individual case, selected debit and credit card payments as well as in-person cash payments may be accepted.
Where the customer pays by debit or credit card, the customer transmits their card details to Zurich Tourism simultaneously with submission of the order. Upon verification of the customer’s identity as the legitimate cardholder, Zurich Tourism will promptly instruct the card company to initiate the payment transaction following the order. The payment transaction will be processed automatically by the credit or debit card company and the card will be charged. Zurich Tourism reserves the right to issue an advance invoice for confirmed services.
At its sole discretion and by prior agreement, Zurich Tourism may offer payment by invoice. In such cases, the invoiced amount is due in full within 30 days of the invoice date, without any deductions. Upon expiration of the payment deadline, the customer shall be in default without the need for a formal notice or demand. Zurich Tourism reserves the right to charge default interest and late payment fees. Payment by invoice is not guaranteed and may not be requested as a matter of right.
All prices are stated in Swiss Francs (CHF) and include applicable statutory VAT. For in-person cash payments, Euros may also be accepted at the current daily exchange rate equivalent of the CHF price. However, the customer has no right to pay in Euros. Shipping costs may apply in addition to the listed prices. Customers will be informed of any applicable shipping costs separately during the checkout process.
VI. Intellectual Property Rights
All intellectual property rights (including but not limited to copyrights, trademarks, design rights, and patent rights) in the content of this Website are reserved. The protected elements are owned either by Zurich Tourism or by third parties who have authorized Zurich Tourism to use them. No ownership rights or licenses of any kind are granted to visitors of this Website with respect to any elements of the Website, Apps, or software, including but not limited to any rights in copyrighted or trademarked content.
The content and all elements on the Website may only be downloaded or printed provided that no copyright notices or other proprietary designations are removed and that proper attribution to the source is given. Zurich Tourism expressly reserves all rights.
The reproduction, transmission, modification, or use of the Website or Apps, in whole or in part, for public or commercial purposes is prohibited without the prior written consent of Zurich Tourism and without full source attribution. Separate license terms apply to Zurich Tourism’s Open Data Portal, as set forth on the portal.
VII. Data Protection
The collection and processing of personal data by Zurich Tourism is described in the Data Protection Policy. The Data Protection Policy forms an integral part of these T&Cs, and the customer acknowledges having read and agrees to be bound by it. The Data Protection Policy is available at www.zuerich.com/en/data-protection.
VIII. General Provisions
1. Severability
If any provision of these T&Cs is wholly or partially invalid, it shall be replaced by an equivalent provision that most closely reflects the economic intent of the invalid provision. The validity of the remaining provisions shall not be affected.
2. Amendments to T&Cs
Zurich Tourism reserves the right to amend these T&Cs at any time. The current version will be published on this Website or in the App and will apply to orders placed on or after the date of publication. The version in effect at the time of the order shall govern.
3. Jurisdiction and Governing Law
The contractual relationship between Zurich Tourism and the customer is governed exclusively by Swiss law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually resident in an EU member state, the mandatory consumer protection laws of that state shall apply in addition. Subject to any mandatory statutory jurisdiction, disputes between Zurich Tourism and the customer shall be submitted to the courts at the registered seat of Zurich Tourism. For consumers habitually resident in a country other than Switzerland, jurisdiction shall be determined in accordance with applicable statutory provisions.
4. Controlling Language
In the event of any discrepancy between language versions of these T&Cs, the German version shall prevail.
